Did you know that in Spain, when a person passes away, we have a way of checking whether or not they signed a will, when, where, and if the deceased person had a life insurance policy?
In Spain there is a document known as a certificate of last will and testament, that certifies whether or not the deceased person made a will in Spain, before which notary’s office and on what date they did so.
It should be noted that this document is compulsory when dealing with an inheritance in Spain and can be requested by anyone with knowledge of the inheritance. However, we recommend that it should be your lawyer, on your behalf, who manages it, as he/she will be able to go to the corresponding notary’s office after obtaining the requested certificate.
It is important to note that this certificate, which is compulsory to manage and process the inheritance, can only be requested 15 days after the death, and only if you have the relevant documentation for this specific procedure.
In the same application, if you wish, you can also request the life insurance certificate, which establishes whether there is a life insurance policy, either associated with the bank or individually, taken out beforehand.
If you have any doubts about how to apply for these certificates or you have pending inheritance management, we recommend you contact Imont Legal & Taxes. Our experts in inheritance will advise you and, above all, will guide you and help you to manage the necessary documentation in such important and difficult moments as these.
