Buying a Resale Property in Mar de Pulpí, Almería: Complete Legal Guide for Foreign Buyers

Buying a Resale Property in Mar de Pulpí, Almería: Complete Legal Guide for Foreign Buyers

Buying a second-hand property in Mar de Pulpí (Almería) is an excellent investment opportunity, whether you are looking for a holiday home, a permanent residence or a rental property. However, the process involves several legal steps that require expert guidance.

At Imont Legal & Taxes, our office in Mar de Pulpí, San Juan de los Terreros, specialises in assisting international clients throughout the entire conveyancing process in Spain, ensuring a safe and stress-free purchase.

1. Reservation Agreement: Securing the Property

The first step when buying a resale property in Spain is signing a Reservation Agreement with the estate agent. This removes the property from the market and requires a deposit, usually between €5,000 and €10,000.

This deposit can be paid either to the agency or to your lawyer’s client account for added security.

2. Legal Checks and Due Diligence

Once instructed, your lawyer will request all necessary documentation from the seller to begin the legal searches, including:

  • Title deeds of the property
  • Land Registry report (Nota Simple)
  • Habitation license from the Town Hall
  • Utility bills (water, electricity, gas)
  • Local property tax (IBI) receipts
  • Licences for any extensions or building works

At IMONT, our Mar de Pulpí legal team ensures that the property is free from debts, charges or legal risks before proceeding.

3. Private Purchase Contract

Your lawyer will prepare a Private Purchase Contract, including:

  • Details of buyer and seller
  • Full property description
  • Price of purchase
  • Payment terms
  • Agreed completion date

Although bilingual contracts are common, the legally binding version is always the Spanish one.

4. Power of Attorney: Simplifying the Process

Granting a Power of Attorney to your lawyer is highly recommended. It allows us to:

  • Apply for your NIE number
  • Sign documents on your behalf
  • Manage the completion process
  • Transfer utilities after purchase

With a Power of Attorney, you do not need to travel to Spain for completion, making the process much more convenient.

5. Purchase Costs in Andalusia (Almería)

When buying a property in Mar de Pulpí (Andalusia), you should budget for additional costs:

  • Transfer Tax (ITP): 7% in Andalusia
  • Notary fees: approx. €1,500 – €2,000
  • Land Registry: approx. €1,000 – €1,500
  • Legal and administrative fees

If you are applying for a mortgage, additional costs will apply.

6. Important Legal Searches Before Completion

Before completion, your lawyer will carry out essential checks:

  • Land Registry: ownership and possible charges
  • Town Hall: confirmation of tax payments
  • Utilities: verification of outstanding bills
  • Community of Owners: certificate of no debts

If any debts are detected, your lawyer will retain funds to ensure the property is transferred free of charges.

7. Spanish Bank Account

Opening a Spanish bank account is  not mandatory, but you will need an account from a land that belongs to the European Union in order  to manage:

  • Utility payments
  • Local taxes (IBI)
  • Community fees

We recommend choosing a bank that offers international services and online banking in your language.

8. Reference Value (Valor de Referencia)

Since 2022, property taxes in Spain are calculated based on the higher of:

  • The purchase price
  • The cadastral reference value

This value is set by the Spanish Cadastre and may affect the total tax payable.

9. Completion at the Notary

Completion takes place at the Notary office, where:

  • The Title Deeds (Escritura) are signed
  • The buyer pays the remaining balance
  • The seller hands over the keys

If you attend in person, your lawyer will act as translator to ensure you fully understand the process.

10. After Completion: Utilities and Registration

After signing the deeds, our Mar de Pulpí office will handle:

  • Transfer of utilities into your name
  • Payment of taxes
  • Registration of the property at the Land Registry

Final registration typically takes 2–3 months, although you become the legal owner on the day of completion.

Key Considerations When Buying a Resale Property in Almería

  • Properties are sold “as seen”
  • The seller is not always legally required to provide a habitation license
  • Extensions may not be registered and should be checked carefully
  • It is advisable to arrange property insurance
  • Avoid booking flights until completion is confirmed
  • Consider appointing a key holder if you are a non-resident
