The Police Department of Murcia has announced that from June 2023 it will no longer be permitted for NIEs application for foreigners using a power of attorney signed in a country other than Spain.
The reason for this is the strict application by the Police of Article 260 of the Regulation on the Rights and Freedoms of Foreigners in Spain (Royal Decree 557/2011, of 20th April), which states that “in the event that the foreigner is not in Spanish territory at the time of the application, he/she will request the assignment of NIE to the General Department of Foreigners and Borders, through the Spanish Consular Offices abroad.”
This is why Imont Legal advises all its collaborating real estate agencies to try to take advantage of their clients’ trips to Spain to coordinate with the lawyers the signing of a power of attorney in a Spanish notary’s office, with the additional advantage of a lower cost of the power of attorney signed in Spain compared to powers of attorney signed in the UK, Belgium or Holland.
At Imont Legal & Taxes we are at the side of real estate agencies to help them offer an exceptional service to their clients and resolve their doubts about NIEs application.
